COVID-19: Visa- und Aufenthaltsanträge/ Visa & residence permit applications

Personen, die für einen Aufenthalt von bis zu 90 Tagen nicht der Visumpflicht unterliegen sowie jene, die visumpflichtig und zu Beginn der COVID-19 Krise im Besitz eines gültigen Visums waren und derzeit im Bundesgebiet aufhältig sind, müssen entweder das Bundesgebiet rechtzeitig verlassen oder ihren Aufenthalt bei den Inlandsbehörden regeln.
 
Wenn es derzeit jedoch aus faktischen Gründen nicht möglich ist der Ausreiseverpflichtung nachzukommen, und eine Regelung des Status aufgrund der Sperre des Parteienverkehrs bei den Inlandsbehörden ebenfalls nicht möglich ist, wird von Strafverfahren Abstand genommen. In diesem Falle hat die verspätete Ausreise auch keine negativen Implikationen auf eine allfällige Ausstellung eines neuen Visums. Sobald es die Situation wieder erlaubt, ist das Bundesgebiet sobald als möglich zu verlassen.

  • Personen, die eine Staatsangehörigkeit der Europäischen Union, des Europäischen Wirtschaftsraums (NO, IS, FL), der Schweiz oder des Vereinigten Königreiches besitzen können gemäß EU Verordnung 2004/EG/38 im Bundesgebiet bleiben.

Persons who do not need a visa for a stay of up to 90 days as well as those who require a visa and held a valid visa at the beginning of the crisis and are currently residing in Austria, must either leave Austria or arrange their stay with the domestic authorities.

If, however, it is currently not possible for factual reasons to comply with the departure obligations, and it is not possible to arrange a regulation with the domestic authorities due to the current suspension of office hours, criminal proceedings are waived. In this case a late departure will have no negative implications on the issuing of a new visa. As soon as the situation allows, the person has to leave the federal territory.

  • Persons who are citizens of the European Union, the European Economic Area (Norway, Iceland, Liechtenstein), Switzerland or the United Kingdom can remain in Austria in accordance with EU Regulation 2004/EG/38.
